2. Payment

        2.1 Deposit and cancellation

• 50% Deposit due on placement of order.
• Balance due 2 weeks before delivery. No work will be started unless paid in full. Please note that some preparations start well in advance.
• Deposits are non-refundable.
• No refunds will be made for orders cancelled within the two weeks before the wedding, the full amount will be lost.
• COVID-19 exceptions are made according to the South-African government’s lockdown requirements.

        2.2 Small orders or late orders

• Late orders or orders less than the value of R1500, payment must be made in full 7 days before collection/delivery of the order.
• No work will be started unless paid in full. Please note that some preparations start well in advance.
• Deposits are non-refundable.
• No refunds will be made for orders cancelled within 7 days before collection/delivery, the full amount will be lost.

        2.3 Gift vouchers or prizes

• Gift vouchers/prizes are valid for 12 months from the date of issue.
• Gift vouchers/prizes can not be exchanged for cash.
• Gift vouchers/prizes are only applicable on baked goods.
• Gift vouchers/prizes may be exchanged for baked goods of a higher value, on payment of the difference.
• Delivery, packaging or rental items are not included in the gift voucher/prize.
• Gift vouchers/prizes will be subject to verification.
• Gift vouchers/prizes that are defaced in any way will be invalid.
• Vouchers/prizes must be mentioned at time of ordering your baked goods.
• Vouchers/prizes may not be used simultaneously with other running specials. One voucher/prize applicable per cake.
• Vouchers/prizes handed out at wedding expos are exclusively redeemable on wedding cakes.
• Gift vouchers may only be exchanged for one cake, balance will be forfeited.

3. Refundable deposits on rental items

• Rentals on any products like cake stands, knifes etc.: Rental deposit will be paid back in full if item(s) are returned in the same condition.
• Cake stands and glass plates must be returned to Dainty Delights Couture Cakes within 3 days after the wedding function.
• A fine of R500 per day will be levied for late returns, as the stand is booked and paid for in advance by other brides.
• Should your late return result in forcing Dainty Delights to sub-rent a similar stand you will be held liable for the cost incurred for the stand rental as well as the fine and fees Dainty Delights must incur to get the stand back (collect, Uber, Tolls, travelling costs etc.) up until your cake stand is returned.
• Should the stand be lost you will be held responsible for the fine of R500 per day as well as the replacement value of the stand up until the settlement is reached between Dainty Delights and yourself.
• All changes to the quotation and cake flavours must be confirmed in writing via email.
• The quotation is only deemed accepted as soon as the 50% deposit is paid into the bank account stipulated on the quotation and proof of payment is emailed to This email address is being protected from spambots. You need JavaScript enabled to view it.. Use the document number and your name as the reference number.
• Please note to remove items before serving: support dowels in tiered cakes, ribbon, wires in sugar flowers, Swarovski crystals, flower picks & flower tape etc.
• Returns should be within 3 days, after, no refunds will be made.

 4. Collection and Delivery

        4.1 Collection

• Agreement will be made on collection or delivery of order.
• On collection of the cake, risk passes to the client the moment the cake has been handed over.
• No responsibility whatsoever will be taken by us for any damages or deterioration of the cake due to unfavourable conditions, transport or storage.
• No cakes larger than two tiers may be collected.
• No wedding cakes may be collected unless otherwise agreed.

        4.2 Delivery

• Full details must be given on date, venue, time of delivery etc.
• Picture will be taken of the cake after delivery.
• Please appoint a responsible person at the venue to take responsibility of the cake after delivery.
• No responsibility will be taken by us for any damages or deterioration of the cake due to unfavourable conditions or storage at the venue. This includes unfavourable weather conditions, fire places etc.
• Roads in poor condition can cause damage during transport. Dainty Delights take no responsibility whatsoever for poor road conditions, and damaged caused during transport. We should be made aware at all times if conditions are not favourable so that extra precautions can be made to the best of our ability.

5. Best before dates and allergy information

• Our products are made in a kitchen that handles nuts, eggs, dairy, gluten, and other known allergens. Although we take care to minimise cross-contamination, we cannot guarantee that any item will be completely free from allergens.
• Guidance will be provided regarding the recommended consumption period as well as the appropriate storage and handling of your cake. In most cases, cakes should be kept in airtight containers and refrigerated to maintain freshness.
• Once the cake has been collected or delivered, Dainty Delights Couture Cakes cannot be held responsible for storage conditions or environmental factors that may affect product quality or food safety. As our products contain fresh ingredients, improper handling may result in spoilage.

6. Non-edible decorations, fresh flowers, foliage, structure and AI-generated images

• Items such as wired sugar flowers, supports (plastic, metal, or wooden dowels), cake boards, cake toppers, ribbons, pins and similar components are structural elements and are not edible.

• Dainty Delights Couture Cakes will not accept responsibility or liability for any allergic reactions arising from florals used on Cakes and other products.

• Clients are welcome to provide reference images (including online examples) to guide the design, and we will always make every reasonable effort to recreate the requested style as closely as practical using real-world (food-safe) techniques.

• Please note that some images online (including digitally created, AI-generated, or heavily edited designs) may show exaggerated colours, finishes, textures, or structural elements that are not physically achievable in edible materials, and therefore the final result may differ from such references.

• Our priority is always to deliver a beautiful, safe, and structurally sound product that reflects the requested style as far as practically possible.

   

7. Force Majeure clause

• Force majeure. A Party shall not be deemed in default of this Agreement nor shall it hold the other Party responsible for, any cessation, interruption or delay in the performance of its obligations (excluding payment obligations) due to earthquake, flood, fire, storm, snow, natural disaster, act of God, war, terrorism, armed conflict, labour strike, lockout, boycott or other similar events beyond the reasonable control of the Party, provided that the Party relying upon this provision:
• * gives promote written notice thereof, and * takes all steps reasonably necessary to mitigate the effects of the force majeure event. * If a force majeure event extends for a period in excess of 30 days in the aggregate, either Party may immediately terminate this Agreement upon written notice.

8. Copyright

• Designs/logos and photos remain the property of Dainty Delights and may not be published, sold, printed or distributed without our consent.
• Designs may not be changed or damaged during styled photoshoots, or published without consent.

9. Privacy

• We respect the confidentiality of all personal information provided to us. Any details you share will be used solely for the purpose of processing your order and communicating with you regarding our products or services. We do not disclose personal information to third parties unless required by law or with your explicit consent.

10. Liability

• If a mistake has been made that do not adhere to the order specifications signed by you, we are only liable to the amount of the cost of the specific cake/mistake.
• No losses beyond this point.

11. Customer Satisfaction Guarantee

• We promise to make your brilliant cake according to your requirements provided on our order form. Note that the cake artist’ interpretation is used as no cake can be copied 100%.
• If the cake is for any unforeseen reason dry or stale, refund to the cost of the cake will be given if 90% or more of the cake is returned within 24 hours of delivery. A personal meeting will be arranged for the tasting.
• Telephonic complaints will with regard to the taste or quality of the cake will not be accepted, and no refunds will be made in this regard.
• By placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
